Notice regarding compliance with August 2024 Title IX regulations
The Federal District Court of Kansas in State of Kansas v. U.S. Department of Education enjoined enforcement by the U.S. Department of Education of the revised Title IX regulations against any college or university attended by a member or child of a member of certain identified voluntary member associations. Henry Ford College was listed as one of the higher education institutions attended by such member(s). The revised Title IX regulations that were to be effective August 1, 2024, at Henry Ford College are on hold pending further court action.
The purpose of the Title IX office is to support our community in creating and sustaining an environment that is free from all forms of sexual miscounduct and discrimination.
Henry Ford College policy prohibits and will take strong action against any form of sexual miscounduct or discrimination against any member of our College community. We respond to all complaints through due process and established procedures.
- Everyone at HFC whether if be staff, faculty, or student is protected under Title IX from any form of discrimination on the basis of sex.
- Any student who believes they are subject to any type of discrimination or sexual misconduct must report the incident(s) to the attention of the Student Title IX Coordinator or Deputy Title IX Coordinator.
- Any HFC employee who believes they are subject to any type of discrimination or sexual misconduct must report the incident(s) to their immediate supervisor or bring their complaint to the attention of the Title IX Coordinator, Employee Deputy Title IX Coordinator, Executive Director of Human Resources, or any member of the College administration. HFC will investigate each complaint thoroughly and confidentially.

Sexual Misconduct (Title IX) Policy
The College complies with Title IX of the Education Amendments of 1972 (Title IX), and its implementing regulations (34 C.F.R. Part 106, as amended by 85 FR 30026 (May 19, 2020). Title IX is a federal law stating: No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance, including admissions and employment. Title IX also includes, but is not limited to, pregnancy/pregnancy-related issues and gender equality in athletics, academic programs, and activities.
The purpose of the HFC Title IX Policy is to prevent, address, and eliminate sexual misconduct. In addition, this policy describes the process for reporting violations, investigating written complaints, and the method to adjudicate alleged violations. This policy also identifies resources available to HFC community members who are involved in an alleged incident of sexual misconduct.
What is considered sexual misconduct under Title IX?
Under the Title IX regulations, sexual misconduct include, but are not limited to, behaviors such as:
- rape
- sexual assault
- sexual battery
- sexual harassment
- sexual coercion
- domestic violence
- dating/relationship violence
- sexual exploitation
- stalking
The Title IX regulations also stipulate that any unwelcome conduct that a reasonable person would find so severe, pervasive, and objectively offensive that it effectively discriminates against any person, regardless of sex, sexual orientation, and/or gender identity, is considered sexual misconduct within the scope of Henry Ford College.
Who must report Title IX policy violations?
All College employees are considered responsible employees and are required to promptly report allegations of sexual misconduct or other violations of this policy within a maximum of three business days to either:
- the Title IX Coordinator or designee and/or
- Campus Safety
All College employees means:
- the College's Board of Trustees
- all HFC full-time, part-time, and temporary employees*
- all HFC faculty
- all HFC staff
All College employees must promptly report sexual misconduct that they observe or learn about that involves a member of the College community or occurred at a College event or on College property. It includes misconduct by anyone or toward anyone, including contractors and visitors on HFC property or at an HFC event.
All College employees are required to report this information, regardless of whether the complainant indicates they plan to report the incident. If you have questions, please refer to the Title IX Resource Guide for guidance in your reporting obligations.
*The College's licensed counselors are confidential employees and are not required to report sexual misconduct incidents to the Title IX Coordinator without the permission of the complainant.
